Wade’s ex-wife protests outside Daley Center

The ex-wife of Miami Heat star Dwyane Wade on Friday took to the streets to get her side of the story told — literally sitting on the sidewalk outside the Daley Center with a sign.

“NBA Miami Heat star, mother of his children on the streets,” Siohvaughn Funches-Wade’s sign read. She said she was driven to the act after a frustrating several days in court this week, as the post-divorce saga between the one-time high-school sweethearts continues to play out.

The former couple, who grew up in south suburban Robbins, have two children together.

Wade, a Richards High School graduate and three-time NBA champion now dating actress Gabrielle Union, filed for divorce from Funches-Wade in 2007. Their 2010 divorce, custody battle — Wade gained sole custody of the children in 2011 while his ex-wife retained visitation rights — and post-divorce relationship has been nothing short of messy.

After a grueling week of court developments in which Funches-Wade sought to fire her attorney — her legal representation paid for by Wade, she has gone through 12 lawyers — and a week in which she was arrested by Circuit Court Judge Thomas Carr for appearing late in court, she’d had it.

Leaving Friday’s hearing, Funches-Wade plopped down on a mat outside the downtown courts building, with her sign and her sister and mother at her side supporting her.

WTF ... she has gone through 12 lawyers fighting him but he is paying for them. That seems pretty bizarre.

Wow, only $5M? Wade is a lucky man.

http://chicago.cbslocal.com/2013/07/23/dwyane-wade-to-pay-ex-wife-5-million-in-divorce-settlement/

CHICAGO (STMW) – Basketball superstar Dwyane Wade will pay his former high schoolsweetheart, Siohvaughn Funches-Wade, $5 million in a divorce settlement that a judge decided was valid on Monday, the Sun-Times is reporting.

The settlement also includes a “non-disparage” agreement in which each party must refrain from making disparaging remarks about the other.

Funches-Wade also will receive the couples’ former mansion in South Holland and four cars.

Brian Hurst, an attorney for Funches-Wade, argued that his client never fully agreed to all the provisions in the settlement, including the “non-disparage” provision. But Cook County Circuit Court Judge John Thomas Carr decided both parties did agree on the deal and he found the settlement valid, effectively ending a six-year divorce proceeding that has drawn national attention.

Exactly what will constitute a disparaging remark still needs to be hammered out, but Wade’s attorney, James Pritikin, expects violation of the terms would result in a fine. Pritikin said protection from disparaging remarks also would extend to Wade’s family members, as well as his girlfriend, actress Gabrielle Union.

Outside the courtroom Monday, Funches-Wade expressed her displeasure with the decision. “My voice isn’t for sale, my story isn’t for sale, no thank you.”

Wade did not attend the hearing.

Funches-Wade, who on Friday sat outside the Daley Center with a cardboard sign that read: “NBA Miami Heat star, mother of his children on the streets,” has repeatedly said the three-time Miami Heat champion has not kept his obligation to pay $25,000 a month in spousal support.

Pritikin dismissed the assertion and issued a written statement Monday afternoon: “Dwyane Wade has made several requests over the years to settle this matter, despite Ms. Funches having 16 different attorneys and 2 arrests throughout this process. Mr. Wade has provided a very generous settlement to Ms. Funches to continue to live a wonderful lifestyle for the rest of her life. Despite false allegations by Ms. Funches claiming to be ‘homeless’ and ‘destitute,’ Dwyane Wade has maintained over the years financial support to his ex-wife by providing her with income over $25,000 on a monthly basis, timely paid for her home mortgage, maintenance and security at the house, 4 cars, insurance, taxes and all of her attorney fees throughout this process.

“Ms. Funches has made a mockery of homelessness which is a serious and personal issue for Mr. Wade as his mother was homeless for a period of time when he was a child. Dwyane Wade was awarded sole custody of their sons by the court in 2011,” the statement continued. “The safety and well-being of his children are his main priority. Due to Ms. Funches’ current unstable mental state, her visitation will be determined by the court. Mr. Wade continues to hope that one day he will have a civil relationship with his ex-wife for the sake of their sons.”

Hurst said he was not happy with the judge’s decision and planned to explore his legal options.

The couple married in 2002. They have two sons, Zion and Zaire. Wade filed for divorce in 2007, and the divorce was finalized in 2010. Wade was awarded sole custody of their kids in 2011.

Wade grew up in Robbins and attended Richards High School in Oak Lawn before playing basketball for Marquette University in Milwaukee.

$25,000 a month wasn't enough for her to live. :man10: Well, the marriage finally paid off for her now, she should be satisfied, job well done.

Wade, ex-wife divorce battle escalates - Chicago Sun-Times

It just keeps getting uglier.

The divorce saga of Miami Heat star Dwyane Wade and ex-wife Siohvaughn Funches-Wade — reportedly ending in a $5 million settlement in a Chicago courtroom on Monday — moved to the courtrooms of Miami the same day, over her rights to child visitation.

Wade refused to turn over the couple’s two sons to Funches-Wade on Monday for a two-week visit as previously scheduled, instead filing an emergency motion in Miami demanding she submit to a psychological evaluation or lose rights to any future visits with her children.

In the filing, Wade cites his ex-wife’s anger over the course of the five-day settlement trial, and her emotional display at the Daley Center after its fourth day — when she sat outside on the sidewalk telling her story to the media and public.

“S.L.’s [Funches-Wade’s] statements, behavior, and her demeanor in court reflect that she is presently lost, angry and desperate. Her behavior is not in the children’s best interests...D.T. [Wade] requests that this Court immediately suspend S.L.’s timesharing...pendin g the results of a psychological evaluation of S.L.,” Wade’s filing by his attorneys reads.

Funches-Wade, in a statement, told the Sun-Times there is nothing wrong with her.

“This is Mr. Wade’s ongoing pattern of behavior. I have noticed that after I speak out publicly and say what Dwyane has done to me, my children...Mr. Wade responds by running into court and asking the judge to terminate my visitation with my children in an effort to stop me from seeing my children anymore,” her statement read.

Wade’s attorneys acknowledge the boys were to be dropped off to their mother at earlier in the week, but told the Sun-Times that after the Daley Plaza incident, Wade decided not to, drafting the emergency motion over the weekend and filing it Monday morning.

The $5 million settlement in the former couple’s long-running divorce saga was approved by Cook County Circuit Court Judge John Thomas Carr that afternoon.

Wade’s attorneys and publicists subsequently issued a statement, that read in part, “Dwyane Wade and his ex-wife Siohvaughn Funches have reached a financial settlement...Mr. Wade has provided a very generous settlement to Ms. Funches to continue to live a wonderful lifestyle for the rest of her life...Mr. Wade continues to hope that one day he will have a civil relationship with his ex-wife for the sake of their sons.”

Funches-Wade’s attorneys told the Sun-Times Wade’s filing has no legal impact on terms of the custody judgment, and that the mother should have received her children pending a hearing on Wade’s motion, currently scheduled to be held Tuesday in the Circuit Court of Miami-Dade County.

After four days of unsuccessful communications between the couple’s attorneys, Funches-Wade on Thursday filed an Unlawful Visitation Interference report with the Dolton Police Department, accusing Wade of violating their 2011 custody judgment.

That judgment calls for the NBA star and his ex-wife to “have equal parenting time with the children in the summer in alternating two-week blocks of time,” and apprise the other always of the children’s whereabouts.

According to the Dolton police report, “The victim [Funches-Wade] further states that her attorney contacted the offender’s attorney and parenting coordinator, however neither would disclose the whereabouts of the children.”

Dolton Police say they believe they have no jurisdiction in this case.

Funches-Wade’s attorneys say they intend appear in court on Tuesday and demand Wade turn over the children, and seek sanctions against the three-time NBA champion.

But Wade’s attorneys say they believe they have a solid case.

The one-time high-school sweethearts grew up in south suburban Robbins, and were married in 2002. Wade, now dating actress Gabrielle Union, filed for divorce in 2007.

It never ends ... Dwyane Wade's ex-wife is poking the hornet's nest again -- this time demanding the right to publicly bash the NBA star.

Dwyane and Siovaughn Funches wrapped up their bitter six-year divorce in July, after Wade agreed to provide a generous financial settlement. As part of the deal Funches agreed to a gag order, prohibiting her from talking smack about their relationship.

But Funches has now filed legal docs challenging the settlement, claiming she never agreed to several terms -- including the gag order.

She wants a judge to nullify the agreement, which would force Wade back to the bargaining table.

As for the gag order, Funches says ... if Wade is free to bash her in his book , she should have the same right to bash him. A judge has yet to rule on her request.

Calls to Dwyane's people weren't returned.
